Public Liability
This covers all the activities normally associated with a swimming club or school, including normal swimming, occupancy of office premises used in connection with the swimming club or school, social or business trips, training, competitions, or sub-aqua (other than away from the club pool and SCUBA) events. The cover extends to activities anywhere in the world for UK residents, and includes members, officials, voluntary helpers and the like. Note that cover for the Club or School for claims arising out of abuse of children or vulnerable adults will only be considered where all teachers and all officials have had satisfactory Criminal Records Bureau checks, and a satisfactory abuse questionnaire has been submitted. There is never cover for claims made against the individual abuser as abuse is a criminal act.
The Public Liability cover provided by this insurance applies to all instructors and teachers when carrying out their activities in accordance with the normal rules of the swimming club, and within their individual qualifications. The cover provided by the policy issued to a specific club or school does not extend to cover teachers acting outside the activities of that club or school. The extended cover is provided by the main STA members’ cover.
For non affiliated STA members the policy does not extend to provide indemnity outside the specific club or school’s activities. Any instructors or teachers who are not members of the STA should have their individual cover provided by their own professional association.
It is important to realise that the Public Liability cover applies only where there is a legal liability, such as created by negligence. The mere fact injury or damage has occurred does not necessarily mean that a successful claim can be made.
“Member to member” liability is automatically included. This provides cover to a member who injures a fellow member negligently.
Where Local Councils or pool owners require the provision of Public Liability cover as a condition of the hiring contract, their interest will be included. Liability assumed under such contracts will also be included where it would otherwise apply in the absence of the agreement. Please note that we must be advised if you are involved in the day to day running/operating/management of the pool itself. (e.g. Chlorination, Cleaning and Maintenance).
The standard limit of indemnity will be £5,000,000 any one incident, except in respect of pollution, or goods or food and drink sold or supplied where the limit will be in the aggregate in any one period of insurance. Higher limits are available upon request at an extra cost.
Legal Defence costs are covered up to £250,000 in the aggregate for defending proceedings arising out of the Health and Safety at Work Act 1974 or part 2 of the Consumer Protection Act 1987.
Pool closure
For clarification the indemnity provided under the Public Liability section of the insurance does not extend to indemnify you or any person attending a swimming session in circumstances where the water is contaminated by an individual pool user or swimmer which results in closure of the pool.
